1. Welcome & Agreement
Welcome to Blaze Stream, ("Blaze," "we," "us,"). Blaze Stream is a platform for live streaming, chat, community interaction, digital collectibles (NFTs), subscriptions, and tips paid with crypto tokens. By using Blaze Stream, including connecting a wallet, opening a custodial account, creating content, streaming, watching, or purchasing/minting NFTs, you agree to these Terms of Service (the "Terms").
These Terms incorporate by reference our Community Guidelines, Privacy Policy, Payments & Digital Asset Terms, Brand/Advertising Guidelines, and any other policies we post (together, the "Guidelines"). If these Terms conflict with a policy, the Terms apply unless the policy explicitly says otherwise.
We may update these Terms at any time. The “Last Updated” date reflects the current version. If we make material changes, we’ll notify you through reasonable means (for example, in-product or by email). Continuing to use Blaze Stream means you accept the updated Terms.
Defined Roles. "User" means anyone accessing the Service; "Creator" means a User who streams or earns from the Service; "Custodial Wallet" means a digital asset wallet operated by us or our partners where we control the private keys; "Non-Custodial Wallet" means a wallet you control directly; "Digital Asset" means cryptocurrencies or NFTs supported by Blaze.
2. Custodial & Non-Custodial Wallets
We provide both custodial and non-custodial wallet options:
Custodial Wallets. If you use a custodial wallet, you authorize Blaze (and our licensed providers) to hold and manage digital assets for you, and to process transactions based on your instructions. Custodial wallets are not bank accounts, not FDIC insured, and carry blockchain risks.
Non-Custodial Wallets. If you use a non-custodial wallet, you alone are responsible for managing your private keys, devices, and recovery phrases. Transactions you approve are final and irreversible.
We may freeze or delay transactions in custodial wallets to comply with law, sanctions, fraud review, or system maintenance. We are not responsible for losses from lost keys, incorrect transfers, or scams.
CRYPTO & CUSTODIAL RISK WARNING. ON-CHAIN TRANSACTIONS ARE FINAL; KEYS CAN BE LOST OR STOLEN; SMART CONTRACTS MAY FAIL; NETWORK FEES AND CONGESTION MAY APPLY; AND REGULATIONS MAY CHANGE. YOU USE CUSTODIAL AND NON-CUSTODIAL FEATURES AT YOUR OWN RISK.
3. NFT Sales & Clip-to-NFT
Blaze may offer digital collectibles (“NFTs”), including one-click Clip-to-NFT features that let you mint or purchase stream moments as NFTs. By using these features, you:
Understand that NFTs are speculative digital items with no guaranteed value or liquidity.
Accept that on-chain NFT transactions cannot be reversed.
Grant Blaze a license to host, display, and promote your NFT content within the Service.
Blaze makes no promises about secondary market value, resale rights, or the long-term storage of NFT metadata. NFT features are provided “as is.”
4. DIGITAL ASSET RISK DISCLOSURE
TRANSACTING IN CRYPTOCURRENCIES AND NFTS IS RISKY. RISKS INCLUDE (BUT ARE NOT LIMITED TO):
PRICE VOLATILITY AND LOSS OF VALUE;
IRREVERSIBLE TRANSACTIONS;
SMART CONTRACT FAILURES OR HACKS;
NETWORK DELAYS, FEES, OR FORKS;
LOSS OR THEFT OF KEYS, DEVICES, OR CREDENTIALS;
SCAMS, FRAUD, AND SOCIAL ENGINEERING;
CHANGES IN LAWS OR TAX RULES THAT AFFECT USE OR VALUE.
YOU ACCEPT THESE RISKS AND USE BLAZE STREAM AT YOUR OWN RISK. WE DO NOT PROVIDE FINANCIAL, LEGAL, OR TAX ADVICE.
5. Content & Ownership
Your Content. You keep ownership of your streams, uploads, and other contributions. To operate the Service, you give Blaze a license to display, distribute, and promote your content, including creating clips, previews, or NFTs if you enable those features.
Your Responsibilities. You must only upload or mint content you have rights to. You are responsible for compliance with copyright, publicity, and other laws.
Removal. You may delete your content, but copies may remain in backups or in already-minted NFTs.
6. Payments & Subscriptions
Crypto Only. All payments on Blaze Stream are made in USDC or $BLAZE tokens on supported networks. We may add or remove supported networks or supported tokens at our discretion.
Finality. Blockchain transactions are final and cannot be reversed. Double-check addresses, chains, and amounts before confirming.
Gas & Fees. You are responsible for gas fees and any third-party charges. Fees may change with network conditions.
Refunds. Payments are non-refundable unless we explicitly say otherwise or where required by law.
Subscriptions & Tips. Subscriptions renew automatically where applicable. Tips, donations, and one-time payments are voluntary and non-refundable.
Creator Payouts. If you are a Creator, earnings are sent to the wallet you specify. Payouts may be paused or reversed for fraud review, compliance checks, or policy violations.
Taxes. You are responsible for reporting and paying any taxes related to your transactions or earnings.
No Custody Guarantee. Blaze is not a bank, broker, or money transmitter. Custodial wallets are provided for convenience only and are subject to holds or freezes if required by law.
No Advice. Nothing on Blaze Stream is investment, financial, legal, or tax advice.
7. Community Guidelines & Prohibited Conduct
By using Blaze Stream, you agree to follow our Community Guidelines. You may not use the Service to:
Break any law or infringe on others’ rights (copyright, trademark, privacy, or publicity).
Harass, bully, threaten, defame, or promote hate or violence against others.
Post or stream illegal content, exploitative material, or excessively sexual or obscene content.
Promote scams, fraud, pyramid schemes, or misleading financial products.
Impersonate another person, entity, or brand without authorization.
Artificially inflate metrics (views, follows, tips) through bots or other manipulation.
Upload malware, attempt to hack, or interfere with the Service.
Evade suspensions, bans, or enforcement actions.
Violations may lead to removal of content, suspension of features, or termination of your account. Blaze reserves the right to enforce these rules at its discretion to keep the community safe.
8. Eligibility
You must be at least 13 years old to use Blaze Stream. Users under 18 must have a parent or guardian’s consent.
You may not use Blaze if you are suspended, terminated, or legally barred under U.S. or other applicable law (e.g., sanctions lists).
9. Termination & Enforcement
We may suspend or terminate your account, wallets, or access to features if you violate these Terms, our Guidelines, or applicable law. We may also remove or block content at our discretion. On termination, licenses you granted for operating the Service may continue as necessary for backups, legal compliance, or already-minted NFTs. You may close your account at any time, but obligations accrued before closure (e.g., taxes, payments) remain enforceable.
10. Third-Party Content & Links
The Service may contain links to third-party sites, wallets, smart contracts, or services. Blaze does not control or endorse third parties and is not responsible for their availability, accuracy, legality, or security. Your dealings with third parties are at your own risk.
11. Intellectual Property & DMCA
Blaze respects intellectual property rights. If you believe content on Blaze infringes your copyright, send notice to our DMCA Agent:

Your notice must comply with 17 U.S.C. § 512. We may remove content and terminate repeat infringers. Submitting false claims may make you liable for damages.
12. Feedback & Suggestions
If you share ideas, suggestions, or feedback, you grant Blaze the right to use them without obligation or compensation.
13. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE.” To the maximum extent permitted by law, Blaze disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, secure, or error-free operation.
14. Limitation of Liability
To the maximum extent permitted by law, Blaze and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Total liability for all claims will not exceed the greater of $100 or the amount you paid directly to Blaze in the 6 months before the claim (excluding blockchain fees).
15. Indemnification
You agree to indemnify and hold harmless Blaze, its affiliates, officers, and employees from claims, damages, losses, or costs (including legal fees) arising from your use of the Service, your content, or your violation of these Terms or others’ rights.
16. Arbitration & Dispute Resolution
Except where prohibited by law, disputes will be resolved by binding arbitration in Cheyenne, Wyoming, under the Federal Arbitration Act. You waive the right to jury trial or to participate in class actions. You may opt out within 30 days of first agreeing to these Terms by emailing [email protected] with subject line “Arbitration Opt-Out.”
17. Governing Law & Venue
These Terms are governed by the laws of the State of Wyoming and applicable U.S. federal law. Exclusive venue for disputes not subject to arbitration will be state and federal courts in Laramie County, Wyoming.
18. Export Controls & Sanctions
You may not use Blaze if you are located in or subject to jurisdictions restricted by U.S. law or on U.S. government prohibited-party lists. You agree to comply with all export and sanctions laws.
19. Miscellaneous
Assignment. You may not transfer these Terms without consent. Blaze may assign without restriction.
Severability. If any part is unenforceable, the rest remains valid.
No Waiver. Failure to enforce a right is not a waiver.
Entire Agreement. These Terms plus referenced policies form the entire agreement between you and Blaze.
Survival. Provisions on payments, content, IP, disclaimers, liability, and dispute resolution survive termination.
